Welcome to Clear Casa! These Terms of Service (“Terms”) govern your access to and use of the Clear Casa platform and related services at clearcasa.io (the “Service”), operated by Clear Casa LLC (“Clear Casa”, “we”, or “us”), headquartered in Tucson, AZ.

By accessing or using our Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least the minimum legal age in your jurisdiction (e.g., 18 in the US or EU) to use Clear Casa. By using the Service, you represent that you meet this requirement.

2. Description of Service

Clear Casa provides a platform for uploading home inspection PDFs, which are analyzed using AI to generate reports, action plans, and negotiation insights. The Service is currently free, but this may change in the future.

3. User Content & Data Rights

• Ownership: You retain ownership of all PDFs and information you upload to Clear Casa.
• Usage Rights: By uploading, you grant Clear Casa a non-exclusive, worldwide, royalty-free license to process, analyze, and (anonymously) use your reports and related data for product improvement, research, testing, aggregated insights, and marketing (e.g., sharing learnings or highlights on social media, always without personally identifiable information).
• Data Anonymization: We will keep your data anonymous in any public or commercial use, in accordance with US and EU compliance laws.
• No Sales: We do not sell your personal information.

4. User Responsibilities

• You may only upload reports and data you have the legal right to use.
• You are responsible for maintaining the confidentiality of your account.
• Do not use the Service for any unlawful, fraudulent, or abusive activity.

5. AI Recommendations & Disclaimer

• Informational Use Only: AI-generated reports and recommendations are for informational purposes only and should not be relied upon as professional advice.
• Verification Required: Users must independently verify any recommendations with qualified professionals.
• No Warranty: We make no guarantees about the accuracy, reliability, or fitness for a particular purpose of the reports or insights generated by Clear Casa.

6. Limitation of Liability

• No Liability: Clear Casa is not liable for any damages, losses, or claims arising from your use of the Service, including but not limited to reliance on AI recommendations.
• Maximum Liability: In any case, our total liability is limited to the amount paid by you for the Service in the twelve months preceding the claim (currently $0 if the Service is free).

7. Data Privacy & Use

• Your data may be processed and stored by third-party vendors (Supabase for storage/database, PostHog for analytics, Anthropic for AI processing) as described in our Privacy Policy.
• Data used for product improvement, analytics, or marketing will be anonymized and aggregated.
• We will never spam your email or sell your personal data.

8. Account Termination & Data Deletion

• You may request account or data deletion at any time by contacting us at info@clearcasa.io.
• We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms or inactivity.

9. Changes to the Service or Terms

We may update or modify the Service or these Terms at any time. We will post material changes on clearcasa.io. Your continued use of the Service after changes means you accept the new Terms.

10. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
